At Safewill, the Powers of Attorney you create will only come into effect if you lose your decision-making capacity.
Primary Attorney
Your chosen attorney can generally do anything in relation to your legal and financial affairs that you can do for yourself i.e. opening a bank account, selling property.
There are a few differences across the Australian states for example in NSW your attorney cannot act on your behalf as a trustee.
Attorneys generally cannot act on your behalf as a director of a company.
If you require specific advice about the tasks that your attorney may carry out in reference to your personal circumstances, we recommend seeking professional advice.
Substitute Attorney
The role of your nominated Substitutes varies from state to state.
In Victoria and Western Australia the role of your nominated financial substitute/s is to act in circumstances where any one of the Primary Attorneys is unable to act.
In the remaining states the role of your nominated financial substitute/s is to act in circumstances where none of the Primary Attorneys are able to act.
