An executor is the person responsible for carrying out the wishes stated in your Will and they must act in the best interest of the beneficiaries. Generally, if a specific gift is made in a Will, that gift must be transferred to the beneficiary.
However, when it comes to leftover assets (known as the residuary estate) the executor has the discretion about whether to liquidate the assets and split the money between beneficiaries, or keep the assets in physical form and transfer ownership of those assets to beneficiaries in the required proportion. The executor should ask the beneficiaries of the estate if they have any preference in relation to the liquidation or transfer of estate assets.
When it comes to what should happen to an estate (either liquidating all assets or continuing to service loans etc.) many of our customers will include notes in the asset section to help their executor in understanding and identifying their wishes (although these notes are instructive only and do not bind the executor).
