The law does provide certain people with the right to make a claim on a person’s estate for adequate provision. As such, if these eligible people (such as spouses or children) are unhappy about the amount they receive under a Will, it could lead to them contesting the Will.
The Court will of course consider a person’s wishes contained in their Will when determining the success of a claim. If you are unsure whether someone has a claim upon your estate or require advice specific to your situation about how to avoid a contested estate, we recommend seeking independent legal advice.
Safewill offers the ability to book a telephone consultation with a specialist Wills lawyer from our affiliate law firm Safewill Legal. One of their lawyers can talk to you about your personal circumstances, and advise you on your Will accordingly, including providing family provision advice. The cost of this service is $199.00, which can be added at the checkout once you’ve completed your Will.
